Description:
While we cannot yet refer to a body of Remote Deposit Capture “Case Law”, there is a lot to learn from the disputes that have occurred between financial institutions, their customers, and other financial institutions involving RDC. This session, conducted by two leading experts on Remote Deposit Capture, will focus on actual RDC disputes involving several financial institutions and the outcome of these disputes and practical best practices. The session will focus on legal issues surrounding Remote Deposit Capture, the potential outcome if litigation occurs and what financial institutions can do to improve the successful outcomes of litigation. For example, under the Uniform Commercial Code, a financial institution has certain defenses that it can raise on claims of forged endorsements. In order to take advantage of those defenses, the financial institution must prove that it took the items in accordance with reasonable commercial standards in the banking industry. This session will address some of those defenses and the procedures that a financial institution should have in place to meet reasonable commercial standards.
